Terms of Service
Effective date: September 25, 2026
These Terms of Service ("Terms") apply to your use of eastbayelixirs.com (the "Site") and to requesting quotes and booking services from East Bay Elixirs LLC ("East Bay Elixirs," "we," "us," or "our"). By using the Site or booking with us, you agree to these Terms. Each booking is also governed by a signed Service Agreement; if the Service Agreement and these Terms conflict, the Service Agreement controls.
Our services
East Bay Elixirs is a certified and insured mobile bartending service. We provide bartenders, bar equipment, a portable mobile bar, menu planning and related event services. Optional add-ons, such as mixer packages and ice service, are described in your quote.
We do not sell, supply or provide alcohol. Our services are dry-hire: the client purchases and supplies all alcoholic beverages for the event. We provide a custom shopping list to help you plan.
Booking, payments and cancellation
Submitting an inquiry, requesting a quote, or communicating with East Bay Elixirs does not reserve an event date or create a binding agreement. A booking is confirmed only as specified in the applicable Service Agreement.
Quotes are based on the event details you provide and are valid for the period stated on the quote. Changes to guest count, hours, location or services may change the price.
Deposits, payment schedules, gratuity, cancellation, rescheduling and refund terms are set out in the Service Agreement provided for each booking. The signed Service Agreement controls the specific terms of your event.
Responsible alcohol service
Our RBS-certified bartenders serve only alcohol purchased and supplied by the client, and follow California responsible beverage service practices. By booking, you agree that:
- •Only guests 21 or older will be served, and our bartenders may check ID for any guest
- •Our bartenders may refuse service to anyone who appears underage, cannot show valid ID, or appears intoxicated
- •Our bartenders may slow, limit or end bar service if they believe continuing would create a safety risk, with no refund owed
- •The client and host are responsible for guest conduct, for arranging safe transportation for guests who need it, and for complying with venue rules and any required permits
Client responsibilities
The client agrees to provide accurate event details; safe access to the venue for setup and breakdown; a suitable, level area for the bar; the alcohol and any items listed as client-supplied in the quote; and a day-of timeline and point of contact. Additional time needed because of late venue access or schedule changes may be billed at our hourly rate.
Damage and equipment
Our equipment and portable mobile bar remain our property. The client is responsible for loss of or damage to our equipment caused by guests, other than normal wear and tear.
Insurance
We carry general and liquor liability insurance for our services. A certificate of insurance is available to your venue on request.
Use of the Site
You agree not to misuse the Site, including by submitting false information, interfering with its operation, or attempting to access it without authorization. All Site content, including our name, logo, photos, menus and text, belongs to East Bay Elixirs LLC and may not be copied or used without our written permission.
Disclaimers
The Site and its content are provided "as is." Drink recipes, shopping list quantities and planning estimates are provided as guidance and may vary with your guests' preferences and consumption. We do not guarantee that the Site will always be available or error-free.
Limitation of liability
To the fullest extent permitted by law, East Bay Elixirs' total liability arising from the Site or our services is limited to the total amount you paid us for the event at issue. We are not liable for indirect, incidental or consequential damages. Nothing in these Terms limits liability that cannot be limited under California law.
Indemnification
You agree to indemnify and hold harmless East Bay Elixirs LLC and its staff from claims arising from the alcohol you supply, guest conduct, or your breach of these Terms or the Service Agreement, except to the extent caused by our negligence or willful misconduct.
Governing law
These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Alameda County, California.
Changes to these Terms
We may update these Terms from time to time. Changes apply to bookings made after the updated Terms are posted; existing bookings follow the Service Agreement you signed.
